Public benefit measure (VPO)

A non-building measure in a Czech zoning plan, e.g. flood or erosion protection or a wildlife corridor. As with a VPS, land can be expropriated for it.

Under the Czech Building Act a public benefit measure (veřejně prospěšné opatření, VPO) is a measure of a non-building nature designated in zoning documentation that serves to reduce hazards in the territory (e.g. floods or erosion), to create parts of the territorial system of ecological stability (ÚSES, i.e. habitat cores and wildlife corridors) or to develop or protect natural, cultural and archaeological heritage. It is designated in the zoning plan, and measures of supra-local importance also in the regional development principles.

How to find a measure in the plan

  • In the zoning plan it appears on the same drawing as public benefit constructions: the drawing of public benefit constructions, measures and clearance areas.
  • In plans drawn up in the uniform standard, measures have codes starting with V, e.g. VU for ÚSES elements or VN for hazard reduction.
  • The description and purpose of each measure are in the text part of the plan.

What it means for an owner

As with a public benefit construction, rights to land needed for a VPO can be taken away or restricted by expropriation, only in the public interest and only if no agreement can be reached with the owner. If a VPO lies on the plot being bought, expect the affected part to serve another purpose, such as a grass strip, a field boundary or new planting, and the municipality or the state may want to buy it.

What it reveals about the area

Measures nearby are usually positive: flood protection, new greenery or a wildlife corridor. They also show why they are needed. An area reserved for flood or erosion protection suggests the locality is at risk of flooding or soil wash-off. It is therefore worth checking the flood zone map and the flash flood risk as well.

Frequently asked questions

Does the measure have to be carried out?

Designation in the plan means the land is protected for the measure and can be acquired for it. Whether and when it is actually carried out is not set by the plan; that depends on the municipality, region or state and on funding.
