Listing appointment
The first meeting of an agent and a seller, where the agent pitches for the listing: viewing the property, suggested price, approach and contract.
A listing appointment (náběrová schůzka, colloquially náběr) is a meeting between a real estate agent and a property owner who is considering selling or renting. The agent views the property, finds out what documents exist and explains how they would market it and at what asking price. The goal is to sign a brokerage contract (smlouva o realitním zprostředkování).
What the law says
Under Act No. 39/2020 Coll., real estate brokerage always includes finding someone who wants to sign a purchase or rental contract with the client, and usually also advertising, assessing the property's condition and proposing an asking price, marketing, viewings, obtaining technical documentation, and arranging legal services and escrow (Section 3). The brokerage contract must be in writing and must identify the property, state the price or rent (or how it will be set) and state the commission; otherwise it is invalid, and only the client can raise the invalidity (Sections 9 and 10).
What to watch in the contract
- An exclusive brokerage with a consumer can be agreed for at most 6 months. It can be extended repeatedly, but no earlier than 30 days before the agreed term ends (Section 17).
- For an open-ended contract with a consumer, the notice period can be at most 1 month (Section 18).
- An advance on the commission from a consumer may not exceed two thirds of the agreed commission (Section 19).
- The contract may not oblige a consumer to sign a purchase or rental contract or an agreement on a future contract (Section 14).
What to prepare
It helps the seller to have a title sheet extract, the energy performance certificate, documents on renovations and inspections ready, and to know about any easements or mortgages. The owner should give the agent the graphic part of the certificate; without it, the agent must state the worst energy class in advertising (Act No. 406/2000 Coll., Section 7a). Agents, in turn, benefit from bringing facts about the location and its risks to the meeting, for example from a location check or a sample website with a location analysis.
