Utility network existence statement
A network owner's or operator's reply on whether its network runs in an area and what protection zones apply. It must tell anyone, free of charge.
A statement on the existence of networks (sdělení / vyjádření o existenci sítí) is issued by the owner or operator of technical infrastructure, such as an electricity or gas distributor, a water company or a telecom operator, for a specified area such as a land parcel. It says whether its equipment runs there, usually with a location drawing, what protection zones apply and under what conditions work is allowed in them.
Who can ask and what it costs
Section 168(b) of the Czech Building Act requires infrastructure owners to provide, free of charge and to anyone who asks, information on connection conditions, protection and safety zones and the basic conditions for activities in them. According to ČÚZK methodology this includes the network's location. Infrastructure managed by the Ministry of Defence or the Ministry of the Interior is excluded. So an agent or buyer can apply, not only the landowner. Large distributors have online portals for requests.
Statements under the new Building Act
Under the new Building Act (No. 283/2021 Coll.), a building permit application must include statements from the owners of public transport and technical infrastructure recorded in the digital technical map. These cover whether and how the project can connect and the conditions of protection zones. According to ČÚZK, the existence of networks is no longer part of that statement; it is checked in the DMVS portal and the regional map. Which owners and operators to contact for given parcels is listed by a DMVS portal function nicknamed the 'traffic light' (semafor).
What the statement does not tell you
The statement describes networks and zones, not the condition of a particular house. It does not say whether the house is actually connected, what circuit breaker it has or what state the service connection is in. The drawing may not show the exact position on site either: before any earthworks, operators' conditions usually require the network to be marked out.
May the operator charge a fee for the statement?
Not for the information listed in Section 168 of the Building Act: it must be provided free of charge. Failure to do so is an offence for which the infrastructure owner can be fined up to CZK 400,000.
