Note in the land register (poznámka)
A land register entry flagging an important fact such as enforcement, insolvency, a pending lawsuit or a ban on disposing of the property.
A note (poznámka) is one of the three types of rights entries in the Czech land register, alongside registration (vklad) and a record (záznam). It is used to enter important information about registered properties or about the recorded owners and other holders of rights (Section 6 of the Cadastral Act). Unlike registration, a note does not create a right; it flags a fact that may restrict the property or its owner.
Most common notes
- On the property: an enforcement order to sell the property, an order for execution of a decision, a filed application for a judicial or bailiff's lien, an interim measure, a pending lawsuit, the start of land consolidation, or a ban on disposing of the property (Section 23).
- Note of disputed entry: someone claims that an entry does not match the actual legal position and seeks redress in court (Section 24).
- On the person: enforcement proceedings against the owner, an insolvency decision or a declaration of bankruptcy (Section 25).
How to read it
On the title sheet (LV), notes are in part D. Notes directly tied to rights in part C, for example to a mortgage, are listed there (Section 23 of Decree No. 357/2013 Coll.). The cadastral office enters a note on the basis of a decision or notice from a court, bailiff, tax authority, insolvency administrator or other body, or on a supported application from the person it benefits (Section 22). Until it is entered, the property shows a pending-transaction flag.
What to watch out for
A note about enforcement warns that, once notified of the start of enforcement, the owner must not dispose of their assets, including real estate, subject to exceptions in the Enforcement Code. A contract made in breach of this ban may be invalid (Section 44a of Act No. 120/2001 Coll.).
A note of disputed entry warns that if the court upholds the claim, the cadastral office will delete the entries the note applies to, including entries based on them (Section 24 of the Cadastral Act). This also affects a buyer who acquired the property after the note was entered.
Frequently asked questions
How is a note deleted?
The cadastral office deletes it on the basis of a decision or notice from the body that caused it, or on a supported application once the reasons for it have ceased (Section 27). A note of disputed entry is deleted if the applicant does not prove within two months of the request that they have brought the claim in court (Section 986 of the Civil Code).
