Properties with land register discrepancies
A ČÚZK cadastral map layer showing mismatches between the register and reality left unresolved after a revision, e.g. an unrecorded building.
“Properties with discrepancies” is a cadastral map layer in the online viewer Nahlížení do KN and, since 9 May 2022, also in the ČÚZK web map service. According to the ČÚZK help pages, it shows unresolved discrepancies found during land register revisions, i.e. cases where the register does not match the actual situation on the ground and the mismatch could not be corrected.
Where discrepancies come from
During a revision, the cadastral office compares register data with reality (Section 35 of the Cadastral Act). A revision covers mainly parcel boundaries, building outlines, land type and land use and the use of buildings (Section 43 of Decree No. 357/2013 Coll.). The office first discusses a discrepancy with the authorities and the owner. If a document the owner should supply is missing, ČÚZK publishes information about the unresolved discrepancy for that property in Nahlížení do KN.
Typical discrepancies according to ČÚZK:
- a different land type or land use than recorded,
- a different use of a building,
- a building outline on the map that does not match reality,
- a building that exists on site but is not recorded in the register.
How to read it
On the map, properties with a discrepancy are marked with a yellow area and red hatching. Clicking a plot opens its details, where the discrepancy is described together with a proceeding number.
What it means for a buyer
A discrepancy does not disappear with a sale. It is the owner's duty to report changes to the register data on their property to the cadastral office within 30 days and to support them with a document (Section 37 of the Cadastral Act). Recording a new building requires a survey plan and a document showing how the building is used (Section 30). If a discrepancy concerns the house, the access road or a plot you want to buy, find out what it is before signing.
